We take the protection of Personal Data very seriously. All Personal Data collected by the Site will be treated as strictly confidential and will only be used in the manner described in this Policy, as well as in accordance with applicable laws.

With whom do we share your data?

Within the Labelium Group

IKOM is a member of the Labelium Group. Consequently, when justified, your Personal Data may be shared within the entities of the Labelium Group and its subsidiaries in France and throughout the world. Your Data will only be accessible by a limited and defined number of recipients within the Labelium Group and only when strictly necessary.

If you are an existing or potential customer of IKOM, and more broadly of the Labelium Group, employees of IKOM and the Labelium Group who work in the teams that need to have your information (for example, customer relationship management, sales management, legal department, accounting department, compliance, IT, customer service and digital team) will have access to your Data.

Within the Labelium Group

Your Data will generally not be disclosed to recipients outside IKOM or the Labelium Group. In certain cases, however, and in order to carry out our activities, to ensure the hosting of the Site, the technical maintenance of the Site or of our software processing your Personal Data, for the hosting, backup, administration or processing of the Data and/or our emails, IKOM may call upon external service providers acting on its behalf on the basis of contracts which will include strict obligations with regard to data protection.

These include IT maintenance, security and support service providers, hosting providers, marketing and advertising partners, data analytics companies, event providers, publishers of collaborative project management SAAS platforms, Google Workspace cloud storage tool.

Other third parties

IKOM may, in limited cases, transfer your Data to legal or administrative bodies, courts and government authorities, all in accordance with applicable law, and to external advisors (e.g. lawyers, accountants, auditors, etc.), all acting as data controllers.

In this context, IKOM may also transfer your Data to third parties when requested to do so by a legally authorized authority, in accordance with applicable laws and regulations. Finally, IKOM may transfer your Data to another legal entity for the purposes of a collaboration, joint venture, corporate or group reorganization, change of legal form or any other similar event, and/or to provide you with the best possible service. In the event of a merger or sale, your Data will be permanently transferred to the successor company.

Digital partners

There may be digital partners who may process your Data for their own purposes, to the extent permitted by this policy. Processing by these entities is governed by their own privacy policies.

For example, to share social media content, our Site may use sharing buttons. The Site may include third-party links, icons or applications that allow you to share content with others, or to publish your visit or your opinion of the Site's content with others, such as the "Share" and "Like" buttons on social networks such as Facebook, Twitter, Instagram, Pinterest, etc. The provider of these application buttons can identify you via this button, if you use it, and even if you have not used this button but are connected to the social network when you visit the Site (session opened during your browsing). Sharing buttons allow you to connect the content you consult to your user account. Processing by these entities is governed by their own privacy policies.

Is your data transferred outside the European Union?

Data recipients as defined in Article 3 above may involve a transfer of your Data to territories that do not provide the same level of data protection. In such a case, we ensure that all data transfers comply with the applicable legal requirements by signing, in accordance with Article 46 of the RGPD, standard data protection clauses adopted by the European Commission, with our co-contractors.

How long do we keep your data?

We retain your Personal Data in accordance with applicable legal data retention requirements and our internal policies. Data retention will vary depending on the type of data and the purposes of processing.

What are your rights regarding your Data?

In accordance with applicable regulations, you may exercise the following rights with respect to the Personal Data we hold about you:

  • A right to information: you have the right to be informed in a clear, transparent, intelligible and easily accessible form of the Data we hold and how your Data is processed. You also have the right to obtain (i) confirmation as to whether or not your Data is being processed and, if so, (ii) access to and a copy of your Data.

  • A right of access : You have the right to access all the Personal Data we hold about you, to know the origin of this Personal Data and to obtain a copy of it in an understandable format. You may also exercise your right of access to your Personal Data to check its accuracy and have it corrected or deleted. You have no reason to exercise your right of access.

  • A right of rectification: you have the right to obtain rectification of your Data. You also have the right to have incomplete Data completed.

  • A right to erasure: in certain cases, you have the right to have your Data erased. However, this is not an absolute right and IKOM may have legal or legitimate grounds for retaining this Data.

  • A right to object : you have the right to object to the processing of your Data where such processing is based on IKOM's legitimate interests. IKOM may, however, invoke compelling legitimate grounds for further processing.

  • A right to the limitation of processing: in certain cases, you have the right to obtain the limitation of the processing of your Data. This right means that the processing of your data by us is limited, so that we can keep the data, but we cannot use it or process it in any other way.

  • A right to data portability: you have the right to receive your Data that you have provided to IKOM, in a structured, commonly used and machine-readable format, and you have the right to transmit this Data to another data controller without hindrance from IKOM. This right applies only where the processing of your Data is based on your consent or on a contract (see list in Article 2) and where such processing is carried out by automated means.

If you have consented to personal data processing activities, you may withdraw this consent at any time for future processing. Such withdrawal will not affect the lawfulness of processing prior to the withdrawal of consent.

You also have the right to lodge a complaint with a competent supervisory authority. In France, this is the Commission Nationale de l'Informatique et des Libertés (CNIL): https://www.cnil.fr. However, we invite you to contact us before filing a complaint with the competent Data Protection Authority.

How do we ensure the security of your Data?

We use a variety of methods, such as firewalls, intrusion detection software and manual security procedures, to protect your data from loss or damage, to help protect the accuracy and security of Personal Data and to prevent unauthorized access or misuse.

This Policy may be modified by IKOM in accordance with changes in the functionalities of the Site, the services offered and the laws applicable to IKOM's activities. Such modifications and updates are binding on the User, who is advised to check the current Privacy Policy regularly.
